Put simply, CBD is legal. The THC threshold set at <0.3% is a marker that’s been chosen to classify and regulate cannabis by the federal government. The federal limit of 0.3% max THC by weight is set in the United States by the Agricultural Improvement Act of 2018, commonly known as the “2018 Farm Bill”. This law defines hemp as any part of the cannabis plant that contains no more than 0.3% THC by dry weight.
The low THC limit allows for the legal production and sale of CBD products derived from hemp. CBD, or cannabidiol, is a non-psychoactive compound found in cannabis that has gained popularity in recent years for its health benefits.
